If it is fair use to set up a major operation to buy physical copies of books (often used, which means the original copyright holder isn’t even benefiting), tear them up, scan them, and discard them, but it’s not fair use to simply obtain the digital versions of those books directly, then the real world effect is to favor large incumbent companies over small startups, as well as companies who don’t follow U.S. law (like, say, a Chinese AI startup).
